This Acceptable Use Policy (“AUP”) governs the access to and use of UGMail services, infrastructure, platforms, communication systems, applications, administrative systems, domains, hosting systems, APIs, and related technologies operated by ENS Creative Studios Ltd (“UGMail”, “Provider”, “we”, “our”, or “us”).

This AUP forms part of, and is incorporated into, all applicable agreements, subscriptions, services, platforms, websites, systems, and customer relationships associated with UGMail.

By accessing or using any UGMail services (the “Services”), you (“User”, “you”, or “your”) agree to comply with this AUP and all applicable laws and regulations.


1. Purpose

1.1 Why this AUP exists

The purpose of this AUP is to:

a. Protect the integrity, security, stability, reputation, and operational reliability of UGMail infrastructure.
b. Prevent abuse, fraud, spam, illegal activities, and harmful conduct.
c. Maintain compliance with legal, operational, security, and industry requirements.
d. Protect Users, infrastructure providers, third parties, and the broader internet ecosystem.

This policy explains what you can and cannot do when using UGMail, and what actions we may take if it is violated.


2. General Obligations

2.1 Responsible use

You must use the Services only for lawful, authorized, legitimate, ethical, and professional purposes.

2.2 Prohibited general conduct

You must not use the Services in any manner that:

a. Violates any applicable law, regulation, or legal obligation (“Applicable Law”).
b. Threatens or undermines infrastructure stability.
c. Interferes with or disrupts normal operations of the Services.
d. Harms or attempts to harm other Users or third parties.
e. Damages or risks damaging UGMail’s platform reputation or brand.
f. Circumvents, disables, or attempts to bypass operational, technical, or security controls.


3. Spam and Unsolicited Communications

3.1 No spam

You must not use the Services to transmit, distribute, facilitate, originate, relay, or store spam or unsolicited bulk communications of any kind.

3.2 Examples of prohibited spam-related activities

Prohibited activities include, without limitation:

a. Sending unsolicited commercial email or messages.
b. Using purchased, rented, scraped, or harvested mailing lists.
c. Operating unauthorized or non-consensual mailing campaigns.
d. Sending deceptive, misleading, or manipulative communications (e.g., misleading subject lines or sender names).
e. Operating spam networks, open relays, or unauthorized relay systems.
f. Bypassing or attempting to bypass anti-spam systems, filters, or delivery controls.

3.3 Consent requirements

You must maintain lawful consent and authorization for all communications transmitted through the Services. This includes:

  • Verifiable opt-in or equivalent consent where required by law.

  • Honoring unsubscribe or opt-out requests promptly.

  • Keeping accurate records of consent where applicable.

3.4 Enforcement for spam

UGMail reserves the right to suspend, throttle, block, quarantine, investigate, or terminate accounts, domains, or mailboxes involved in spam-related activities.


4. Fraud, Phishing, and Deceptive Activities

4.1 No fraudulent or deceptive use

You must not use the Services to engage in fraudulent, deceptive, misleading, impersonation-based, or malicious communication practices.

4.2 Examples of prohibited fraudulent activities

Prohibited activities include:

a. Phishing attacks (attempts to trick recipients into revealing sensitive information).
b. Credential harvesting or collection of passwords, tokens, or other access data through deceptive means.
c. Identity impersonation of individuals, organizations, or brands without authorization.
d. Sending fake invoices, payment requests, or other financial scams.
e. Operating or facilitating financial fraud schemes.
f. Social engineering attacks or attempts to manipulate recipients into harmful actions.
g. Deceptive domain usage (e.g., lookalike domains intended to mislead).
h. Email spoofing intended to defraud, mislead, or confuse recipients.

4.3 Immediate suspension

UGMail may immediately suspend Services associated with suspected fraudulent or phishing-related activity without prior notice, where necessary to protect Users, infrastructure, or third parties.


5. Malware and Harmful Content

5.1 No malicious software

You must not distribute, transmit, store, execute, or otherwise facilitate malicious software or harmful code through the Services.

5.2 Examples of prohibited harmful content

Prohibited content includes:

a. Viruses.
b. Ransomware.
c. Trojan software.
d. Spyware or keyloggers.
e. Worms or self-propagating code.
f. Malicious scripts or macros.
g. Harmful attachments (e.g., weaponized documents or executables).
h. Unauthorized executable payloads or code designed to compromise systems.

5.3 Security controls

UGMail reserves the right to quarantine, remove, block, or investigate any content suspected of posing security risks to Users, infrastructure, or third parties.


6. Illegal Activities

6.1 No unlawful use

You must not use the Services for any unlawful activities, including, without limitation:

a. Cybercrime or hacking-related activities.
b. Unauthorized access to systems, networks, or data.
c. Financial crimes (e.g., money laundering, fraud).
d. Identity theft or misuse of personal data.
e. Fraudulent commerce or deceptive business practices.
f. Distribution or promotion of illegal materials.
g. Violations of sanctions, export control laws, or trade restrictions.
h. Unlawful surveillance, interception, or monitoring of communications.
i. Any activities prohibited under Applicable Law in any relevant jurisdiction.

6.2 Cooperation with authorities

UGMail may cooperate with lawful investigations, regulatory authorities, or law enforcement agencies where legally required or permitted, including by preserving and disclosing relevant information.


7. Infrastructure Abuse

7.1 No abuse of UGMail infrastructure

You must not abuse, overload, disrupt, interfere with, or negatively impact UGMail’s infrastructure or the infrastructure of our providers.

7.2 Examples of prohibited infrastructure abuse

Prohibited conduct includes:

a. Excessive automated activity or high-volume operations that exceed normal or permitted usage patterns.
b. Operating unauthorized SMTP relays or open relays.
c. Bulk resource consumption that degrades service for others.
d. Circumvention of service limitations, quotas, or fair use policies.
e. Unauthorized system or network scanning, probing, or testing.
f. Attempts to disrupt or degrade service (e.g., denial-of-service activities).
g. Resource exhaustion activities (e.g., mass connection attempts, abusive retries).
h. Activities that negatively affect email deliverability, IP reputation, or domain reputation.

7.3 Operational controls

UGMail reserves the right to implement technical limitations, rate limits, throttling, restrictions, or other enforcement controls where operationally necessary to protect service quality and stability.


8. Security Violations

8.1 Prohibited security-related actions

You must not attempt to:

a. Gain unauthorized access to any account, system, network, or data.
b. Exploit vulnerabilities or security weaknesses in UGMail or third-party systems.
c. Bypass or disable authentication, authorization, or access control systems.
d. Intercept, monitor, or access communications or data not intended for you.
e. Conduct penetration testing, security scanning, or similar activities without explicit written authorization from UGMail.
f. Access restricted systems, administrative interfaces, or back-end services without permission.
g. Circumvent or attempt to circumvent any security measures or protections.

8.2 Reporting security issues

Users are encouraged to promptly report suspected vulnerabilities, security issues, or incidents to UGMail responsibly and in good faith, using the contact details in the “Reporting Violations” section.


9. Intellectual Property Violations

9.1 Respect for intellectual property

You must not use the Services to infringe or violate intellectual property rights, including copyrights, trademarks, patents, trade secrets, or proprietary technologies.

9.2 Examples of prohibited IP-related activities

Prohibited activities include:

a. Unauthorized distribution, sharing, or hosting of copyrighted materials (e.g., software, media, documents) without proper rights or licenses.
b. Piracy-related activities, including sharing or promoting tools or content intended for infringement.
c. Trademark impersonation or misuse of logos, names, or branding in a way that confuses or misleads.
d. Unauthorized reproduction, modification, or distribution of protected content or proprietary materials.


10. Harassment, Abuse, and Harmful Conduct

10.1 No abusive or harmful communications

You must not use the Services to engage in or promote:

a. Harassment or bullying.
b. Threats of violence or harm.
c. Hate speech or incitement to hatred.
d. Defamation or unlawful disparagement.
e. Abuse, stalking, or targeted harassment.
f. Intimidation or coercion.
g. Any harmful, malicious, or abusive communications directed at individuals or groups.

10.2 Enforcement for abusive conduct

UGMail reserves the right to restrict, suspend, or terminate Services associated with abusive or harmful conduct, and may remove or block related content where appropriate.


11. Child Exploitation and Extreme Illegal Content

11.1 Zero-tolerance policy

UGMail maintains a strict zero-tolerance policy toward:

  • Child exploitation or abuse materials.

  • Human trafficking content.

  • Terrorism-related content, promotion, or recruitment.

  • Any other forms of extreme illegal material.

11.2 Reporting to authorities

Any suspected violations in this category may be reported to appropriate authorities and organizations without notice, and may result in immediate suspension or termination of Services.


12. Domain and Email Reputation

12.1 Importance of reputation

Users acknowledge that email infrastructure reputation, IP reputation, domain reputation, and sender trust are critical to the operation and reliability of the Services.

12.2 Prohibited reputation-harming activities

Activities that may negatively affect infrastructure reputation are strictly prohibited, including:

  • High complaint rates (spam reports, abuse complaints).

  • Poor list hygiene leading to high bounce rates.

  • Sending to known spam traps or repeatedly to invalid addresses.

  • Any behavior that risks blacklisting of UGMail IPs or domains.

12.3 Protective measures

UGMail may suspend domains, mailboxes, SMTP functionality, or entire accounts where necessary to protect infrastructure reputation, deliverability, or other Users.


13. Enforcement Actions

13.1 Investigation of violations

UGMail reserves the right, at its sole discretion, to investigate suspected violations of this AUP. This may include reviewing logs, message metadata, content (where legally permissible), and other relevant information.

13.2 Possible enforcement measures

Enforcement actions may include, without limitation:

a. Informal or formal warnings.
b. Rate limiting or throttling of traffic.
c. Temporary suspension of specific features or Services.
d. Permanent termination of accounts or services.
e. Blocking or blacklisting of domains, IPs, or mailboxes.
f. Restriction or removal of SMTP access.
g. Removal, quarantine, or blocking of content.
h. Preservation of evidence for legal or investigative purposes.
i. Reporting of activities to relevant authorities or third parties.
j. Initiation of legal action where appropriate.

13.3 Enforcement without prior notice

Where necessary to protect infrastructure, operations, legal compliance, security, or other Users, UGMail may take enforcement actions without prior notice.


14. Reporting Violations

14.1 How to report abuse or violations

If you suspect a violation of this AUP, or receive abusive, fraudulent, or suspicious communications originating from UGMail infrastructure, you can report it using the following channels:

Please include as much detail as possible (e.g., message headers, timestamps, affected domains or accounts) to help us investigate effectively.


15. Modifications to This Policy

15.1 Right to update

UGMail reserves the right to revise, update, modify, or replace this AUP at any time.

15.2 Publication of updates

Updated versions of this AUP may be published through:

  • Official UGMail websites.

  • Administrative or account management systems.

  • Support portals or documentation sites.

  • Other official communication channels.

15.3 Acceptance of changes

Your continued use of the Services following publication of revised terms constitutes your acceptance of the updated AUP. If you do not agree with the updated terms, you must stop using the Services.
